These Terms and Conditions ("Terms") govern your use of Zophal, a software-as-a-service platform operated by Zophal, Inc. ("we," "us"). By creating an account or using the service, you agree to these Terms. If you don't agree, don't use the service.
1. Your account
The short version: one person per account, keep your password safe, tell us if something looks wrong.
You must be at least 16 years old and provide accurate information when you sign up. You are responsible for all activity that happens under your account. Notify us immediately at [email protected] if you believe your credentials have been compromised.
2. Workspaces and members
The short version: the workspace owner controls billing and roles; members see only what their role allows.
Zophal organizes work into organizations containing one or moreworkspaces. The user who creates an organization is its initial owner. Owners can invite members, assign roles, and transfer ownership. Roles determine what each member can see and do — we won't override that boundary.
3. Your content
The short version: you own everything you upload; we host it so we can serve it back to you.
You retain all rights to the posts, media, and other content you submit ("Customer Content"). You grant us a limited, worldwide license to host, copy, transmit, and display Customer Content only to operate and improve the service for you. We do not sell Customer Content. We do not train third-party AI models on Customer Content.
4. Acceptable use
You agree not to use the service to:
- publish content that is illegal, harassing, or infringing;
- impersonate another person or workspace;
- interfere with the service or attempt to access data not your own;
- send spam through any connected social channel;
- reverse-engineer or scrape the service in violation of these Terms.
We may suspend accounts that materially violate this section. Where possible we will notify you first and give you a chance to fix it.
5. Billing and refunds
The short version: paid plans renew until you cancel; cancel any time and you keep access until the period ends.
Paid plans are billed in advance on a monthly or annual cycle. Cancelling a plan stops future charges but does not refund the current period, except where required by law. We may change prices with at least 30 days' notice; existing prepayments are honored for their remaining term.
6. Termination
You can close your account at any time from Settings → Workspace. We can terminate or suspend accounts for material breach of these Terms after notice. On termination we delete or anonymize Customer Content within 30 days unless we are legally required to retain it.
7. Warranties and disclaimers
The service is provided "as is." We do not warrant that the service will be uninterrupted, error-free, or that all defects will be corrected. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to the service will not exceed the amounts you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
9. Changes to these Terms
We may update these Terms. Material changes will be announced at least 14 days before they take effect via in-app notice and email to workspace owners. Continued use after the effective date constitutes acceptance.
